Hi All
Colleague has been dobbed in to the Hoon Hotline by a vindictive neighbour. Allegedly spun the wheels and exceeded the speed limit in his street. He didn't. He has to present himself and vehicle to local cop station. What the go now? Anyone know what happens? This sort of thing is not fair. Thanks all. |

Without any proof he didn't do it...I'd say it's his word against the neighbours...

They will find it hard to charge him with anything without other witness's but he may well cop a canary when he presents his car

I've always wondered bout this myself. I hate the ''hoon hotlines" and all that.
What stopping a neighbour or someone that has it it for you? I've been wrongly accused around my area. Turned out to be an identical coloured EB/ED a few streets away doing hoonish things. Situation was fixed when a local guy told a cop friend that theres 2 cars in the area like that. All good now. Rant over. Cheers. Trav.

What a crappy thing to have happen!
... unless the person had a radar gun or their own speed camera, or they were following in their car, also speeding, and observing their speedo, how could they know for sure? And most of all, how can they prove it? spinning wheels can be an accident, get him to get legal advice before he goes, but don't say anything, or even admit anything. He may not even legally have to go down. Certainly does not have to defend himself to the Police. One thing though, the Police know they have no rights to make anyone say anything. Unless he admits something, there is no evidence. They usually get suspects to waive those rights after reading them their rights, once they hear them and continue talking or making a written statement, those rights are gone. So my advice is to say nothing, not go and dispute it. When you go and dispute it, they tend to put words in your mouth. But legal advice is always good BEFORE HE GOES DOWN THERE! If they issue your colleague with an infringement notice, it may be better off to pay it and not fight it in court. If anything happened in five years time, where he went to court for a driving matter, if this went to court, it would come up and be used as a "prior." Even if there were charges but no conviction, it will not go as well the second time around. If the infringement is paid, it would not come up in court if something were to ever happen again. The second thing could be accidentally running someone over. If this was used as a prior, it could mean the difference between conviction and no conviction on charges from allegations that are much more serious. Hope this helps. |

The purpose of the "visit" will be for a chat and cautioning to make him aware people are watching and remind him to behave himself, that's all...

Yeah I know we need to keep Hoons off our streets, a proper track in adelaide would be nice too, but I would hate to think of the time wasted on things such as this. I wish they would spend as much time to get my old SS $4000.00 worth of wheels and tyres stolen from my car back.. I had full finger (and hand) prints but they werent interested in them, instead I had to waste my time going to them to make the report..

thanks for the comments - this is so unfair, she's the sort of neighbour that dobs you in if you fart, and unfortunately i live right next door to her. will his car be inspected? it is not overly loud, but visually is in-your-face (body kit, stripes, blah blah). I take it the alleged complaint was for a burnout?
Just make sure the rear tyres are in very good condition when presented to the cop shop. /

the fact they want you to bring your car down as well means they may go over it, is it stock? if not make sure everything is up to scratch or they may get you on something.

he does no wheel spin, no speeding. ever. not in a residential area. this is purely vexatious on her behalf.
the car was loud. she complained. at great expense, car had new mufflers put on that week. in the meantime she calls the hotline. |

Why even go down there, let them get off there a$$ and come and see you. When my shed was broken into the police didnt want to do anything about it because the people involved had tanned skin.Luckily I wouldnt stand for it and retrieved some of the items back, mongrels burnt the car though.

A mate did a big burnout in his street and 1 of his neighbours saw him and rang the police.. the police came to his house and felt the bonnet of the car and looked at the back wheels and surounds for rubber and gave him a court notice.... He could of said it was not me until the cows came home... but he had no chance..
theres also the DECC where you can call up about loud, smokey or vehicles that polute. e.g ciggie out the window... they will send you a letter saying u need an inspection and u must report within a month... so if the litle old lady thinks your car is noisy and complains you will get a letter in the mail asking you to come to this inspection... they figure if your car is fine you have nothing to worry about.... you still waste your time going there nd paying from memory $60 for the inspection...Im not a fan of this. |

i wasn't aware people could do that. make a complaint over the phone with no real proof and suddenly you find yourself having to justify your 'alleged' actions. If this happened to me, i'd be paranoid as my car is stretching the boundaries when it comes to ride height, no maf, aftermarket ecu etc. luckily for me its in very good condition but i still don't like the boys in blue sniffing around more than they have to esp. if i've done nothing wrong.
whatever happened to innocent until proven... |

That was my point that you don't have to defend your actions, but the police will make you feel that you do, so they can put words in your mouth and get
a "confession." |

yeh its a touchy subject.... the best way is to stay out of sight and lay low as much as possible if you have chosen to not comply with the rules.. which is alot of us here...
And be nice to your neighbours and they might turn a blind eye. |

i did a 100 odd metre skid up my street a couple of months back and put the car back in the shed, 2 hrs later the cops turned up as the old lady across the road complained (both elderly ladys next door to me didnt have a drama with it).
They didnt ask to see the car they just told me that a compliant had been made and that it was unacceptable to do that kind of thing (fair call). They told me that they didnt want to come and harress me and that they knew i didnt want them to either and than just said if it happens again that highway patrol would come round and take my car and my lisence. so there not all that bad i could have been in alot more trouble than the warning that they handed out cheers

While in some situations the hoon laws are a good thing (AKA Mcdonalds on a friday night :P) but too have random people reporting other people for their word against the owners in court is getting beyond the joke.
Police are there to do a job, let them do it, not society. |

I would'nt bother going to the cop shop.
If they have a complaint then they should be the ones going out to follow up on it. And i doubt that will happen unless you live next door to a doughnut shop. |

Call her rego into the EPA and tell them you saw her throw a LIT cigarette out the window. They don't take too kindly to that.
