Best peice of advice i could give, is get the BEST legal representation you can or can't afford. Don't get someone cheap, or a duty lawyer, get someone suitably qualified with a proven record in traffic related cases and criminal law. You'll see why when you go to court. I got nailed for running an orange light, only having 1 P plate displayed and careless driving for going through an intersection too fast about 6 years ago. Got the wrong cop on the wrong night, threw the book at me for stuff that really only warranted a talking to but could have seen me off the road for 9 months.

I got a lawyer that cost me about 6 weeks wages at the time and my case was last for the day. He pretty much stood up and made every other solicitor there look like they were still students. Very impressive even down making sure i had character references from people who are seen to have significance in the community, having a large group of family and friends in attendance showing i had great support from those around me. Gave advice on how to get people to word my character references and even where people should sit when in the court room.

He said we could have been cocky and gotten off, but was safer to show i had some remorse and go for 28 days special conditions saying i could only drive for anything relating to work purposes but no conviction recorded and my license not taken.

Worth every $$

2002XR6 - If you ahve no proof the car was sold then they have no proof they bought the car and it is theirs.

Declare it stolen.

If they get pulled up and have proof they bought it from you then that becomes your proof you sold it to them.

How come you didn't do the notice of disposal. In Canberra, its the first thing you do. New owner has 14 days to register the car in their name. You should always take care of the details straight up. Never take anyone's word for it.

If you would like any more detailed info ill check back here later, or PM me, ill try help you find it. There is no substitute for sitting down and nutting it out with a lawyer though, hopefully that is an option for you...

Goodwork, so he will either have to accept the fines or give you your car back for nothing.

Also take the forms that specify another driver was driving your vehicle at the time of the offence, so you can get it all sorted on the spot.

As much as you think you would have to cop all the fines. There's no way you'd actually have to cop them. Once recieved I would have filled out a stat dec to the affect that the car was sold with plates, new owner to provide a r/w cert. After the stat dec the fines will still come but you signed a stat dec stating you no longer own the car. As you no longer own the car police will put a note re the car. If fined by a traffic cop the drive will have to proove they werent driving when the infringments were made. Pretty hard to do when the cop has just pulled you over for speeding. It's called setting precedent.

I have to go through the very same BS when my Mrs has got an infringment notice while she was driving my car. It's a pain but well worth the trouble ;)

If im not mistaken if you claim that it is stolen (not been paid for), and if the vehicle can be tracked down, you still have legal ownership! Knowingly selling goods that you don't have legal ownership over is a criminal offence.

Very goodd point barnsy!

Dont let this blow over and cop a record on your driving sheet. Not only will you be financially out pocket from fines, but your insurance premiums will increase and the fact you lose your licence is ridiculous.

Now you having a starting point with this guy and several avenues you can pursue.

a.) Get him to say he was driving the car.
b.) He should get the fines as he was last known owner. If he refuses this tell him he sold a car legally not belonging to him and that you will now get the cops to charge him with Theft of a motor vehicle and handling stolen goods. That should make him a bit more co-operative!
