Hi all,
On the weekend my mate, my girlfriend and I went for a trip down the Great Alpine Road. I let my buddy, who is on his red P's have a drive of my car and sure enough he was pulled over by the cops in about 30 minutes.. Now, we are all within the age of 16-22 (me being 20 and on my full license), but the catch is that it clearly states on the VicRoads website that when a fully licensed driver is in the front passenger seat the passenger restrictions do not apply.. Anyway, he went back to his car and did the license and registration check ups etc. then come back and said he'd let my mate off with a 'warning'. So, does anyone here actually know what the rules are? Was my mate in the wrong or does the officer not know the law properly? |

If the cop was right, there would have been a fine issued.
I think we went back to his car and thought, crap. |

Yeah, that's what we thought, but even still when he came back he was saying not to do it again and that we know for next time and to take the information on board and so on..

Aren't P plate restrictions listed in full when you get yr licence?
A document given to you....?

If there is a fully licensed driver in the front passenger seat, the peer restrictions don't apply regardless of age. It's a similar principle to a fully licensed driver supervising a learner.
You stated you were 20 and had your full license, seems odd unless you carry a license from outside of Victoria. That may be why the police officer was confused? |

If there is a full licence holder seated in the front passenger seat (MUST be in the front, not in the rear), then the peer passenger restrictions do not apply. I'd say there might have been some confusion, given your age

I'd agree with most people here in saying, yeah it seems like the cop was confused about your age and full licence status. You were right in the end. However because it is a bit of a grey area, I wouldn't risk it again, just to be on the safe side.

Maybe the officer, thought you were lying about having a full licence.
Did the check in the car, and seen you do have a full licence, and let you off. If you are lucky, the cop may have flagged your licence for review and they may do some checks to see if you are on your licence. Also you may want to make sure you are actually on a full licence. Just because your licence may look like a full licence, you may still be classed as a P plater. It happened to me when I moved from P's to full licence, for a month I had the full licence, but I was still classed as a P plater until my time was up. |

Thanks for the replies, guys. I fully agree with the last few posts, no more risks like that from now on. Really don't want to go back to a probationary license.
And yes I'm definitely on my full license. I got a letter from VicRoads stating my graduation from probationary and it also states on my license when my P2 period ended. Cheers. |
