I see defamation cases as a result of this. The 'cheaters' sue the website, they ask the poster for proof. If they have no proof, the website sues the poster.

I don't think an actual cheater would be stupid enough to sue someone if they have actually cheated, as it would blow up in their face if there was damning evidence. But the world does suprise me!

Even if the person is guilty of cheating and admits it, they still have a right to privacy and protection from 'damages'. Many many variables in all this and thats a great thing for lawyers.

You are quite correct that to so dob, could land both the operators of the website and the ex (or not) into court for defamation or other, despite recent legal changes to attempt restriction of this.

With the growing impact of the FTA with the US, where the site is US hosted, this all becomes even easier.

A similar situation applies to 'dob-in' websites about mongrel car drivers or any other subject you can think of.

Under our law at the end of the day you have a right to know your accuser, and the reasons for this *should* be very obvious, but some less than articulate people know not any better.

There is no slander in this case, slander is verbal. The tort in question under the heading of defamation would be libel - written defamation.

Suing under defamation means that the guys would have to prove they have suffered some kind of damages for which they can be compensated for. Usually in a professional sense, it is loss of income as a result of customers not coming to the business in question - that sort of thing. Defamation law does not cover hurt feelings, so that is not the issue.

The main thing is that there must be an action which has caused a negative peception to be put on someone's repuation to the extent that it causes them LEGAL damage.

If the statements are true, then there is no defamation. But its quite a complicated area of law. The guys MAY have a case if they have not done what the girls said they have... who knows?

I dont know how much weight a site like this carries, really. Are other girls going to go on there and try and find their current partner on there? And are they then going to take it seriously, if something is said about him by an ex? I mean, I might hear about something one day about what my partner has done.... I, for one, dont really care what an EX of his has to say - chances are she is his ex for a reason. Exs never say nice stuff about exs... simple as that.

I dont think the blokes should worry so much - most chics are aware of how nasty things can get with exs and that its all just emotional rubbish.

I dont think that the girls are any worse than the guys anyway, on either side. Both genders cheat and treat partners badly and both genders get vindictive... its more down to personality than gender.

I certainly dont take that stuff too seriously.
