There's two reasons I can think of for that.

1) It's not a state, it's a territory.

2) When was the Constitution written (guessing around the time of Federation)? AFAIK, the ACT wasn't started until 1911.

Anyway, I'm from Victoria...

Federation was 1901, the land for Canberra was set aside in 1908, Walter Burley Griffin stared designing Canberra's layout in 1911, and it all became official in 1913.

I can't believe I remembered all that from high school Australian History. Mind you, its the first time I've quoted that info since high school...

ACT is not a state or territory because its only were parliament house is and as stated in the constitution Australia only has 7 states and territories that's why the big star in the Australian flag has 7 points

I'm a little confused that you say the ACT is not a territory, as the acronym actually stands for Australian Capital Territory.

Anyhow, I reckon we are all lucky living in the great land of Oz. The wide brown land with the best beer, spunkiest birds and Ford's finest V8s from coast to coast.
