The only reason the R Spec passed is that it is second stage manufacturing by Herrod. If it was still first stage by Ford themselves it would not have passed. second stage manufacturers do not need to abide by the same ADR's as stage 1 OEM. They only need to pass static noise, not drive by from what I understand. That's why and how it could come to be.
